CISAC’s submission on UK’s Copyright and AI Consultation

CISAC has written a submission for the UK's Consultation on Copyright and AI, supporting its UK societies PRS, DACS, ALCS and Directors UK.
Joining the voices of many UK creators, CISAC advocates for fair and transparent licensing of works used for AI training purposes, and encourages the UK government to reconsider its approach with places the burden on creators to ensure that their works are protected.
This submission highlights five key policy considerations for the UK government when regulating in the sphere of copyright and AI as informed by the questions raised in the UK Intellectual Property Office’s December 2024 Consultation Paper.
We further consolidate our members’ views on several of the UK government’s proposals for reform, ultimately recommending against expanding the exception on Text and Data Mining for commercial uses:
“We strongly recommend against broadening the scope of the UK’s existing TDM exception to permit AI systems or products to commercially exploit copyrighted works, and urge the UK government to encourage fair licensing practices, as well as the introduction of appropriate safeguards against the unauthorised use of creative works in AI applications, such as monitoring, transparency, and disclosure obligations”.
With this submission, it is our intention to share with the UK Government CISAC’s perspective into how best to preserve foundational copyright principles while, at the same time, promoting opportunities for the advancement of AI.
